Electronic Reserves Policies

Copyright Guidelines
 

Electronic Reserves (ERes) is a resource to place copies of course reserve materials online for student access at anytime without needing to come to the library or to wait for a print copy to be made available.

Guidelines for determining fair use are as follows:
  1. the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
  2. the nature of the copyrighted work -- factual or non-fiction works vs. highly creative works such as art, music, or novels.
  3. the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
  4. the effect of the use upon the potential market for or value of the copyrighted work.

There are some instances when copyright limits use of materials for electronic reserve. The library staff will work with faculty in such cases to provide reserve materials.

Fair use guidelines are drawn from federal law. There are some limitations as indicated above. For questions concerning copyright, please contact library reserve staff listed below.

Since copyright with respect to electronic reserves is an unsettled area of law, the Libraries monitor changes in copyright law and will revise this policy as needed to keep it in compliance with the spirit and letter of the current U. S. Copyright Law.
