In a decade defined by fake news, nations have weaponized disinformation to disrupt political, legal and social systems throughout the world. Specifically, in recent years, government leaders have utilized this disinformation against the International Criminal Court (“ICC”) in efforts to deter investigations and prosecutions in politically controversial cases. By focusing on two ongoing examples of disinformation warfare against the ICC by the United States and Israel - two nations currently under investigation by the ICC prosecutor - this presentation will examine the potentially devastating consequences of disinformation on international criminal law and will identify workable solutions for how the ICC can continue to successfully progress in an era of fake news.
